These Terms and Conditions (“Terms”) govern your access to and use of birdhousemgmt.com (the “Site”) operated by Birdhouse Management (“Birdhouse,” “we,” “us,” or “our”). By using the Site, you agree to these Terms. If you do not agree, do not use the Site.

Use of the Site

You may use the Site for lawful, personal, non-commercial purposes related to renting or managing a Birdhouse property. You agree not to:

  • Use the Site to violate any law or third-party right.
  • Submit false, misleading, or fraudulent information through any form or application.
  • Scrape, harvest, or copy listing data, photos, or other Site content for commercial use.
  • Attempt to gain unauthorized access to the Site, the resident portal, or any related systems.
  • Introduce viruses, malware, or other harmful code, or interfere with the operation of the Site.

Rental listings and applications

Listings on the Site are provided for informational purposes. Availability, pricing, deposits, fees, and property details can change without notice. Nothing on the Site is a binding offer to rent. Your rental relationship with Birdhouse is governed solely by the signed lease and any addenda between you and the property owner or Birdhouse.

Applications are subject to screening, including credit, background, income, and rental history checks. Submitting an application does not guarantee approval. Application fees, if any, are non-refundable unless required by applicable law.

Fair housing

Birdhouse is committed to equal housing opportunity. We comply with the federal Fair Housing Act and applicable Ohio and local fair housing laws. We do not discriminate on the basis of race, color, religion, national origin, sex, familial status, disability, ancestry, military status, or any other protected class.

Resident portal and third-party services

The resident portal and listings site are powered by AppFolio, Inc. Your use of those services is also governed by AppFolio’s own terms and privacy policy. We are not responsible for the availability, accuracy, or content of third-party services linked from the Site.

Intellectual property

All content on the Site, including text, graphics, logos, photographs, and software, is owned by Birdhouse or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our prior written permission, except for personal, non-commercial use of listing information for your own rental search.

User submissions

When you submit information through the Site (for example, a contact form, maintenance request, or photo upload), you grant Birdhouse a non-exclusive, royalty-free license to use that information for the purposes of operating our business and providing services to you. You represent that you have the right to submit the information and that it does not violate any third-party right.

Disclaimers

The Site is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, Birdhouse disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.

Limitation of liability

To the fullest extent permitted by law, Birdhouse and its officers, employees, agents, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site, even if advised of the possibility of such damages. Our total liability for any claim arising out of or related to the Site will not exceed one hundred U.S. dollars ($100.00).

Indemnification

You agree to indemnify and hold harmless Birdhouse and its officers, employees, agents, and affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your use of the Site, your violation of these Terms, or your violation of any law or third-party right.

Governing law

These Terms are governed by the laws of the State of Ohio, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Cuyahoga County, Ohio, and you consent to the personal jurisdiction of those courts.

Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date at the top of this page. Your continued use of the Site after changes are posted means you accept the updated Terms.
